The Town Council
What is necessary to stand
at?
You must be French;
You must have fulfilled the obligations of the military service
Code;
You must have no current cause of ineligibility among the ones
foreseen by the law:

Not having been declared insolvent by a tribunal,

Not having been condemned to any sentence neither for crime nor
for criminal offences.
Elections
The minimum age of a town
councillor is 18 and 21 to be mayor.
Ballot mode
For the cities with 3500 inhabitants or more it is a list system
with two ballots. The deposited list must be composed of as many
candidates as seats to fill. In the first ballot the list that wins
the absolute majority of the valid votes obtains half of the seats
to fill. The other seats are divided in relation with the
proportional representation according to the rule of the highest
average between the lists that obtained at least 5% of the valid
votes. If any of the lists obtains the absolute majority, there is
a second ballot. The list obtaining more votes obtains half of
seats to fill. In case of equality in votes between the lists
leading, half of the seats are attributed to the one whose
candidates have the higher age average. The other seats are divided
in relation with the proportional representation according to the
rule of the highest average between the lists that obtained at
least 5% of the valid votes.

A maximum of 30% of the council’s staff can receive a
delegation from the mayor
Number of town
councillors
The number of town councillors is proportional to the size of the
commune. Thus, here is the detail: Number of inhabitants per
commune Number of town councillors per commune Magny-les-Hameaux is
a city of less than 10,000 inhabitants (9,164 inhabitants in the
last census of 2004). The town council of Magny-les-Hameaux is
therefore composed of 29 town councillors.
The Mayor
Elections
The town council elects the Mayor during its first meeting. He
must be at least 21
Responsibilities of the
Mayor

He prepares the town council’s sessions and executes the
decisions made during the deliberations

He manages the public and private property of the Commune
-
He carries out the administration and arrangement actions
decided by the town council beforehand: signing contracts, sales,
partitions, exchanges, purchases, subscriptions of supplies
markets, invitation to tenders for municipal public works.

He guarantees the representation of the Commune to the
tribunals.

He is the hierarchical boss of the staff of the commune.

He is most of the times the president of the administrative
commission or of the board of directors of the communal
institutions.

He is in charge of preserving law and order, security, peace and
public health and to take by-laws for that.
